In a case of importance to the insurance industry, on August 17, 2010, the Supreme Court of Pennsylvania held that an insurer is not entitled to be reimbursed for defense costs, absent an express provision in the written insurance contract. This case will provide guidance and clarity to carriers seeking reimbursement of defense costs requested in reservation of rights letters.

New Jersey Supreme Court Examines the Applicability of Policy Exclusion When Concurrent Causes of Injury Are Alleged

On July 7, 2010, the New Jersey Supreme Court announced its decision in the case entitled Wendy M. Flomerfelt v. Matthew P. Cardiello, 2010 N.J. LEXIS 546 (N.J. July 7, 2010). As discussed below, this decision will likely have a significant impact upon insurers seeking to apply policy exclusions when concurrent causes of injury are alleged in the complaint. Michael Frimet and George Vogrin were recently successful before the Supreme Court of New York, Appellate Division, Second Department, in defending an earlier win by summary judgment before the trial court. Mr. Frimet and Mr. Vogrin obtained a ruling beneficial to their clients, Certain Underwriters at Lloyd's London and London Market Companies, that various statutorily imposed workers compensation assessments for self insureds are not considered "loss" under the terms and conditions of the policies issued by their clients.
